Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs all services provided by GamerNodes (“GamerNodes Services”). By accessing or using these services, the customer (“Customer”) agrees to comply with this AUP. It is intended to safeguard GamerNodes’ infrastructure, our users, and the wider internet.

1. General Responsibilities

The Customer agrees to:

– Use GamerNodes Services only in accordance with this AUP, the GamerNodes Terms of Service, and all applicable laws and regulations.
– Assume responsibility for all activity occurring under its accounts, whether authorized or unauthorized.
– Take reasonable measures to protect login credentials, API keys, and any systems interacting with GamerNodes Services.
– Ensure that all end users, including players, moderators, or other individuals accessing the Customer’s servers, adhere to this AUP. Any violation by an end user is considered a violation by the Customer.

2. Prohibited Activities

The Customer must not use GamerNodes Services to:

– Engage in illegal, fraudulent, harmful, or abusive activities.
– Create, store, transmit, or distribute content that is illegal, abusive, or offensive, including child sexual abuse material (CSAM), terrorist content, or material promoting violence or terrorism.
– Infringe the intellectual property, privacy, or other rights of third parties, including hosting unlicensed software, games, or other content.
– Transmit malware, viruses, or any harmful code.
– Send unsolicited communications, spam, bulk messages, or advertisements.
– Conduct denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks, port scanning, or intrusive network or system testing.
– Mine cryptocurrencies or similar workloads without prior written consent from GamerNodes.
– Violate export control regulations, sanctions, or data protection laws.
– Interfere with or degrade GamerNodes infrastructure, or disrupt other customers’ use of services.
– Perform penetration testing, vulnerability scanning, or other security assessments on GamerNodes systems without prior written authorization.
– Store files on servers that are not actively required for game server operation.
– Artificially inflate file sizes for any reason.
– Intentionally exploite or abuse the unlimited/unmetered bandwidth provided by GamerNodes, including excessive or automated traffic that negatively impacts the performance of our network or other customers’ servers.

3. Enforcement and Updates

3.1 Investigation and Enforcement

GamerNodes may investigate suspected breaches of this AUP. If a violation is confirmed, GamerNodes may:

– Remove offending content
– Restrict access to resources
– Suspend or terminate services
– Close accounts

3.2 Liability

GamerNodes is not liable for enforcement actions taken in good faith under this AUP.

3.3 Updates

GamerNodes may revise this AUP at any time by posting an updated version at https://gamernodes.com/acceptable-use-policy or through other notices. Continued use of GamerNodes Services after the update constitutes acceptance of the revised AUP.

Abuse complaints may be forwarded to the customer responsible for the service. Unresolved or valid complaints may result in suspension or termination.
